Is an online will legal in Florida?
Yes. Florida law does not care whether you wrote your will online, on a typewriter or with a pen. It cares how you sign it.
A will made online is a typed document like any other. What makes it a will in Florida is the signing.
What Florida requires
| Requirement | What it means for you | Florida law |
|---|---|---|
| Age and capacity | You are 18 or older and of sound mind when you sign: you understand what you own, who would naturally receive it, and what the will does. | Fla. Stat. § 732.501 |
| In writing | Typed or printed is fine. | Fla. Stat. § 732.502 |
| Signed at the end, by you | Sign at the end of the will. A will left unsigned, or signed somewhere else, can be rejected even if everyone agrees you meant it. | Fla. Stat. § 732.502(1)(a); Allen v. Dalk, 826 So. 2d 245 (Fla. 2002) |
| Two witnesses, together | Sign while both witnesses are present. Each witness then signs while you and the other witness are present. Keep everyone in the same room. | Fla. Stat. § 732.502(1)(b)–(c) |
| No witnesses, no will | Florida does not accept a handwritten will that was not witnessed. | Fla. Stat. § 732.502(2); In re Estate of Olson, 181 So. 2d 642 (Fla. 1966) |
| Notary | Not needed for the will to count. A notary is needed if you want the will to be self-proving, which lets it be admitted to probate without finding your witnesses later. | Fla. Stat. §§ 732.503, 733.201(1) |
| Fully electronic wills | Florida allows them, under its electronic-will rules, including an online notary for remote witnessing. A printed paper copy signed in person is the simpler route. | Fla. Stat. §§ 732.522, 117.285 |
What Succession Wills does, and what it doesn't
- The will for Florida was designed by a licensed lawyer.
- Nobody at Succession Wills reads or reviews your will.
- It ends with a signing checklist for Florida. The checklist has nine steps and names the Florida rule. Its own advice is a printed paper copy.
- It is not a will until it is printed, signed and witnessed.
- The standard will is free.
