What is a codicil?
A codicil is a legal document that amends an existing will without replacing it. It must be signed and witnessed with the same formality as the original will.
Can I just write on my will?
No. Marking up a signed will can invalidate the change, and in some cases raise doubt about the will itself. A codicil is the correct way to make an amendment.
Codicil or new will?
A codicil suits small, discrete changes. If you are changing several things — or anything structural — a new will is usually clearer and less open to dispute.
Does the codicil need new witnesses?
Yes. A codicil is executed with the same witnessing requirements as a will in your jurisdiction.
How many codicils can a will have?
There is no fixed limit, but each one adds a document that has to be read alongside the original. Once you are on a second or third, replacing the will is cleaner. Your will is free here, so rewriting costs nothing.
Does a codicil replace my original will?
No. A codicil amends it. The original will stays in force and both documents are read together, which is exactly why keeping the number of codicils small matters.
Should I tell my executor about a codicil?
Yes. Store the codicil with the original will and make sure your executor knows both exist. A codicil that nobody can find at the time it is needed has no practical effect.
